It is not totally hypothetical - it represents a claim they will make to recover taxes paid over last few years and could include an accrual for taxes expected to be recovered in future (if there is reason to believe taxes will be paid, i.e., profitability will be achieved). The 40% is derived from 35% federal and something like a 8% state offset by 3% savings on federal for the state taxes paid (35% of 8% state tax rate).
