1. He can't help that much with his case in jail. Who would be better to do proper dd and research in his case? tony.

2. If he's in jail he can't work to make money to support his family. He will lose his house, cars, other property if he stays in jail as he eventually won't be able to make the payments. If he can't work, he can't continue to pay his legal fees. His attorney could dump him and he'd have no representation.

3. Anyone denied bail looks more guilty in the eyes of the public, a jury, the media.

4. Prison life is no fun. I'm sure it's scary and depressing. This will work on his psyche and make him want to admit to things he didn't do just to get out of regular jail where he is now and go to a federal jail.

I believe for all the above reasons the plaintiff would have unfair advantage. Maybe it would be more fair if ken breen and his team had to stay in jail and try to run his case from there.
