I think you need to be able to think for yourself to the extent of being able to recognize an illegal order esp. an order to commit an atrocity, but when ordered to "take that hill" when the hill is full of enemy soldiers (and only enemy soldiers) and the enemy is not trying to surrender then there doesn't seem to be much chance of an illegal order or an atrocity if your unit attacks the hill. It might be that it is a stupid order because it might be better if you just called in an air strike on the hill, or bypassed it and cut it off, but I agree with Chris that we can't have soldiers analyzing every order during a war.
