GMST--Judge Grants EchoStar Summary Judgment Against Gemstar

LITTLETON, Colo. -(Dow Jones)- EchoStar Communications (NasdaqNM: DISH - News) Corp. said a federal court ruled that none of EchoStar's products infringe patents of Gemstar-TV Guide International Inc. .

A Gemstar representative didn't immediately return a telephone call.

In a press release Friday, EchoStar said Judge Lacy H. Thornburg of the U.S. District Court for the Western District of North Carolina granted EcoStar's motion for a summary judgement against Gemstar.

Judge Thornburg dismissed the case and awarded court costs to EchoStar.

Judge Thornburg had previously ruled earlier in July all but two of EchoStar's products didn't infringe the patents asserted by Gemstar. With respect to the two products, Judge Thornburg requested additional information before reaching a final ruling. In Friday's order, Judge Thornburg ruled that the remaining two products also didn't infringe the asserted patents.

Gemstar, which publishes TV Guide and owns patents on interactive program guides for television, saw many of its patents called into question by a recent ruling of the International Trade Commission that found its patents hadn'be been infringed on by Scientific-Atlanta Inc. (SFA), Pioneer Electronics Corp. (PIO) and EchoStar.

In after-hours trading Gemstar, which is 42.6% owned by News Corp. (NWS) changed hands at $3.85 a share according to Island ECN, down 5.8% from a closing price of $4.09 a share. Its 52-week low of $3.79 a share was on July 25 .
