Log On America says to file bankruptcy

PROVIDENCE, R.I., July 8 (Reuters) - Internet service provider Log On America Inc. (Other OTC:LOAX.PK - News) on Monday said it plans to file for Chapter 11 bankruptcy protection and that it has taken back 17,000 subscribers that had been acquired by EarthLink Inc. (NasdaqNM:ELNK - News)


However EarthLink disputed the claim and said it had met all its financial obligations to Log On America, and was continuing to service the subscribers in question.

Log On America said it has taken back the EarthLink customers, representing about $5.5 million in annual revenue, after EarthLink allegedly failed to pay both network fees for July and part of the purchase price for the acquired subscribers.

The company did not specify exactly when it would file for bankruptcy protection but said it planned to file in bankruptcy court in Delaware.

Log On said the bankruptcy would help protect assets and reduce $10 million worth of debt.

The company said on July 2 it believed EarthLink was not reporting accurate subscriber data and said it might have to seek bankruptcy protection and move to reclaim its subscribers.

Shares in EarthLink closed up about 3 percent at $6.59 on Nasdaq. Shares in Log On America last traded at 4 cents on July 3 on the Pink Sheets.
