I am not as afraid of litigation, including a class action, as I would be with other more widely held companies. I would venture to say that the vast majority of shares are held by a relatively few number of people, most (if not all) of whom would not be willing to sue GRNO. That being the case, one disgruntled shareholder may find it hard to establish that he or she would fairly represent the "class", as the law requires. The major shareholders could "opt out" in any event, leaving a relatively small liability exposure for the company.

The company's assets wouldn't warrant an all out legal blitz aginst it, since even a successful plaintiff might only succeed in bankrupting the company, and even the attorneys wouldn't get paid. A party with a large short postition might conceiveably be the only one benefitted, but such a party could only sue on his/her own behalf and not as representative of other shareholders. Bottom line, the threat of litigation exists but practical considerations weigh in favor of GRNO's survival.
