Replay Lawsuit - Any thoughts?

I'm wondering if anyone has any insights or even guesses as to what will happen in the lawsuit against Replay where Hollywood is trying to block both 'skipping commercials' and enabling users (in the hardware) to send files to each other that they recorded on their Replay unit.
