The whole notion of justice revolves around responsibility. Therefore, it will always be an important matter to determine what conditions or transient states undermine the idea of responsibility, and provide mitigation. Thus, for example, we divide murder and manslaughter by the quality of premeditation, and treat manslaughter less severely. The imposition of the death penalty may be a debatable matter, but as long as it is imposed, it is relevant to ask when cognitive debilitation is so severe that holding someone fully accountable would be unjust......
