Premise:

We all recall Cannes, when the Nokia talking face announced to the world that the GSMwCDMA handset in his suit jacket pocket was fully functioning, and that Nokia had 3G multimode handsets ready to go commercial, but would wait for a dramatic unveiling to be synchronized with the opening of Finland's 3G network.

Questions:

Does this very public behavior meet the formal standard for fraud on the part of Nokia?

Is it actionable?

Rhetorical Questions:

Were carriers fed this seeming fiction in private as well?

If not, did carriers collude in Nokia's seeming deception?
