At that point, he had won. The point is that if the recount occurred without settlement of the legal issues, and favored Gore, then Bush sought relief after the fact and won in court, harm would have been done. Thus, expedited review of the legal issues was appropriate... What nonsense. Scalia's argument only makes sense if the court had made up their mind that Bush was right for stopping the vote obviously could cause irreparable harm to Gore. So I suppose Scalia had already decided without a hearing that the Court would depart with pretty much all equal protection precedent and any pretense of following the original understanding of the clause and were determined to set up a standard that essentially every election in history (including the pre-recount in Florida) has violated.
