The article has little legal substance.

Show me where is answers the question of how allowing different counties to use voting machines with different error rates doesn't vioate the court's pronouncement of uniform standards and treatment of all legal votes (including overvotes and undervotes)?

Show me where he explains how the court can break with precedent requiring a showing of purposeful discrimination?

Show me where it explains how the decision can be supported by history. Is Scalia an originalist or not. If he is, shouldn't he have to explain how this decision comports with originalism. Doesn't he have to explain how sexual discrimiantion is not covered under equal protection based upon originalism and voting discrimination is. If he can't, and of course he can't, isn't it an admission that he is simply making a political rather than legal decision. Add to that a decision which is internally inconsistent and not supported by precedent, and you have a decision that can only be explained by political activism.
