All the legal votes were counted and recounted under the rules that existed prior to the election. Your basic premise is flawed.

For the tenth time, the rules that exist prior to the election did not ensure uniform standards and treatment of all legal votes (including overvotes and undervotes) whether it be from different counties to use voting machines with different error rates, the great discretion of the secretary of state, a short deadline of certification that disadvantaged large counties over small. Either the constitution requires uniform standards and treatment of all legal votes or it doesn't.
