JG - It could be defended as legitimate if they could demonstrate that they had a reason for entering into the transaction other than for the purposes of affecting the financials for a particular period, i.e. the "business purpose" test.

In this case I think they would have failed such a test, and considering the preponderance of all the other evidence, the pattern of deceit is pretty obvious. Ditto with WCOM.

Which reminds me, how come the Enron guys haven't been perp walked on Channel 7 yet like everybody else?
