I would think that is standard operating procedure. I wish there were more details. But it sure sounded like the man had time to sober up. He was picked up for drunk driving, that takes up some time I would think, and he was in jail for 3 hours. Obviously we don't have all the details, but I would think it is foreseeable that the person picked up is going to want to retrieve their car. It is NOT foreseeable (and in fact it amazes me) that this guy would take his car and go get drunk again.
