Good question. I just challenge the assertion that clock rate has been the only accepted metric since the beginning. There have been several attempts in the past to have a better metric, even Intel has dabbled in this area...

As far as the suit goes, that's what lawyers do. Heck, apparently it isn't even restricted to the US, note the woman suing because faster than 486 processors make her ill.
