A sitting President does not need the approval of Congress to declare war on a foreign state or entity or group of people calling themselves El do do as long as that body poses a threat to the national security etc of USA, if Congress has a problem with the presidents actions in that regard then they can with-hold funds which would be sorely needed to conduct a war effort or a mini war effort......... Chuck, Thanks for the post but you will need to provide something more in the way of textual argument. I don't know who you are so I can't simply accept your saying it as authority. Now, if by any chance, you are Lawrence Tribe, well then, I would have to rethink that. ;-) As far as the statement goes, my impression is that is interpreted as covering instances of immediate needs for self defense. Pearl Harbor might have been such. (Though I think the Roosevelt administration asked for and got a congressional vote soon after.) But it does not cover the longer term issues we now face with Iraq, a time in which we have not been provoked by an attack from Iraq. That's the whole point of discussing this as a preemptive attack.
