Jesus stayed out of politics. If he had spoken out against capital punishment it would have been an act of sedition against the Roman government, which used crucifixion. Jesus angered the Sanhedrin, which were the ruling clerics of the time. The specific charge against him was blasphemy since he openly forgave sin a right reserved only for God. Pilate the ruling Roman magistrate was openly annoyed the Sanhedrin dumped their squabble with Jesus on him since he was guilty of no Roman crimes. He acquiesced and gave the order for the crucifixion to quell a potential riot by the Sanhedrin, which would have made him look bad to Caesar. Interestingly enough with regard to capital punishment, it would have been impossible for Jesus to be resurrected and assume the role of redemptrix without it.
