For every one legitamate case of an employee suffering a spine injury that is work related, there are 10 that are not related to work. Spinal fusions are very rarely necessary or even beneficial for work related spinal injuries. They are mainly performed to reduce instability associated with normal degenerative changes of the spine. You would have a legitimate claim against the tobacco industry however if your client is/was a smoker. Degenerative disc disease is highly correlated to smoking. Many surgeons will not even perform fusions unless the patient quits tobacco use.
