I believe that shorting against the box DOES allow you to convert to a long term gain and is legal. The reason I believe so is that I remember recent news that Clinton wanted to close that "loophole", meaning that it is OK for now. My own experience is that this works best when you are CLOSE to the one year holding period, but not if you have 11 months to go.
