I agree that the grounds on which the lawsuit was based and settlement terms were as clear as mud in their press releases. I'm not sure anyone could predict what a judge would do if the lawsuit made it to court, however.

Seems that QDEL calculated that either they didn't have much of a chance in contesting the suit, or they didn't want to squander their limited resources fighting it, or a combination of both. They probably sat down like sober business people, calculated best and worst case scenarios if the fought or settled, then came up with a decision that minimized their risk exposure and allowed them to get on with business as usual.

Remember if they lost, they would not only be responsible for their own legal fees, but for BDX's as well. That could have added up to much more than it cost them to settle. Plus they would have had to pay the damages BDX was demanding, and so on.

The settlement is a tough pill to have to swallow, but it could have been much worse. I'm confident that managment did they best they could under the circumstances.

How they allowed themselves to get into this fix in the first place is another question....
