Imagis files defamation action against Red Herring and Mr. Christopher Byron

VANCOUVER, Sept. 12 /PRNewswire-FirstCall/ - Imagis Technologies Inc. ("Imagis" or the "Company") (OTCBB:IGSTF) - Mr. Iain Drummond reports:

Further to the Company's news release of September 9, 2002, the Company advises that it has filed a libel action in the Supreme Court of British Columbia against Red Herring Communications, Inc. ("Red Herring") and Mr. Christopher Byron ("Byron") (collectively the "Defendants"). The action alleges that Byron authored and Red Herring published an article relating to the Company and its directors, which contains statements and innuendo that are defamatory of Imagis.

The Statement of Claim also alleges the misleading and defamatory statements and imputations were written by the Defendant Byron with malice and that he knew or ought to have known that the defamatory imputations he authored were untrue.

It should be noted that MSNBC which originally carried the article that had been posted on Red Herring's website, immediately withdrew it once the Company informed MSNBC of the factual inaccuracies and in the article. However, after the Company notified Red Herring of the facts and identified the defamatory imputations contained in the article, Red Herring published the article in its monthly magazine thereby ensuring wider circulation and causing further damage to the Company.

The Company is seeking an award of both general and punitive damages from the Defendants.
