Although QCOM shareholders may have been burned by First Boston's alleged attempts to manipulate the price, I think that the only kind of action that would stand a good chance in court would be similar to the action taken by the New York State Attorney General Spitzer against Merrill Lynch. Turns out that the New York laws that apply to fraudulent statements are stronger than federal laws, particularly when actions are brought by a committed prosecutor.

Note that when analysts give opinions that seem to be out of wack, the analysts and their firms are careful to call them only opinions, as if they are entitled to express whatever opinion they like under the protection of the first amendment. The catch is whether, by publishing misleading opinions, they were able to profit more than if they had said nothing, or told it like it is.
