heres my line of thought...
- Here in the US, when law enforcement suspects someone of a crime, they may question that person, and detain him/her.
- if prosecution believes there is evidence, it goes to court and the 'accused' is tried.
- If the jury is convinced the person committed the crime they pass a guilty verdict.
-Following that, there is a sentencing hearing, where jurors decide what sentence is appropriate for the crime.

Now, replace "Juror" and "court" by UN, "accused" by Saddam, "Prosecution" by "US/coalition".

IMHO, we are nowhere close to the 'sentencing hearing'.
