one could be justified presuming guilt Yes. That's how burdens of proof operate. As a lawyer I call them BOP (Burdens Of Proof) and who has the BOP matters quite a bit. In the common law (English) system, ordinarily one wouldn't be forced to prove ones' innocence because proving a negative is well known to be difficult if not pointless.
