It doesn't much matter in practice. If the Democrats lose in court, then all the Torch has to do is *resign* (like after the Senate leaves town Oct. 16) and then - under N.J. law - the Governor can call a special election in DECEMBER.

Won't THAT be a *fun* election if, after the November elections, the Senate party balance is still in question :)
