FERC was the one who told EP to lower the operating capacity back in 2000 after the explosion on the same pipeline in August.

Now FERC wants to fine EP for not operating the pipeline at what "it deems" to be the maximum capacity to accommodate the fruits and nuts out in la la land.

First it's too high when safety is an issue, now it's too low when CA cries fowl play.

Give me a break!!

Does anyone believe the court will prevail in telling a company how it should run a pipeline when it is the company who is responsible for the safety and operations of the system? Last time I checked we still lived in America.

This case should be overturned in November. If not it will all the way to the Supreme Court if necessary.

I'd give EP about a 1 in 10 chance of losing this one.
