Also, I've noticed that many stocks are above max pain... is that unusual?

What stocks are above max pain?
Remember, garbage does not count.
By garbage I mean anything that does not have 20K options on it, perferably at multiple strikes. Only heavily optioned stuff adheres well to max pain.

QQQ is about .50 over
MSFT is a near tossup between 47.5 and 50
CSCO is 10
INTC is 15-17.5 virtual tossup
C is 30
IBM is 70 (but I would call 65 a fairly close second)
JPM is 20

All of those are heavily optioned.
All of those ramped hard.
IBM took an "upgrade" and 4 point gap up to get close.
CSCO took an upgrade as well.

So when you say stuff is over Max Pain I am not sure what you mean.

If ELX or NTAP or BRCM or crap like that is over or under pain, that is meaningless. Not enough options on that crap usually to matter.

If INTC tanks the market then look for bios to possibly pick up the slack. If INTC ignites the market then perhaps they dump bios and run chips.

Clean break over 23 will not be good for shorts as that may mean we rally until 2-3 days past expiry.

As for whether or not this is typical, more or less yes. What would be typical would be a rally to max pain and a selloff during expiry week. But In May we rallied and kept right on running, then we were slaughtered in June as no buyers were left. Are we headed into a repeat performance of that? Do not know, but shorts will get bloodied in the meantime if we do.
