A most excellent question.

Since when can the federal government ask itself to use the Department of Defense in individual states?

They've discovered they can be above such quaint notions as "permission" for bringing in the national military into our neighborhoods. The battle cry "terrorism!" is mighty useful for everything from raising taxes (through another trillion or two in spending), winning elections, eliminating Posse Comitatus and who knows what else.
