You both missed the target. There is moral authority, and moral credibility, which have more to do with international cooperation than treaties or laws.

"Certain inalienable rights" are perceived by people worldwide, not just the American founders. Creating policy by force that ignores that is destined for expensive failure, regardless of sophistry.

The US has been good at using its moral authority to gain cooperation of the world.

Until Junior's cabal, that is, deciding war upon Iraq first, and making various excuses later, does not add moral persuasion. Declaring unilateral military preemptive strikes, with secret "evidence", further erodes credibility.
