Tort reform is a difficult issue to legislate, but it can be done. Recourse needs to be commensurate with damage. If any legislation that comes violates our constitutional rights, I'm sure the trial lawyers association will get the courts to overturn it.

$28 Billion to a single sick smoker, who had the right (and responsibility) to choose to smoke or not smoke? Sure, it will be reducued or eliminated on appeal, but why should it ever go that far? Juries and judges need to stop "sending messages" and start making awards that are commensurate with the damage.
