They will need to determine what the damages would be. Given the fact that practically ZERO businesses have found a way to make money on the internet (ie. Explorer is given away), it will be difficult to award damages for lost profits. You can't award damages for lost market cap because as we all know, the market cap for internet stocks was inappropriate to begin with.

The Netscape situation as an example, what are the damages? They still exist and they are still giving away browsers. Are they harmed because less people will use their free browser? Perhaps, but what's the quantity of the harm? Maybe a couple hundred million just for kicks. Find a jury that thinks this is even worth pursuing, and you might have a chance of getting a billion.

Heck, I don't even know why a billion $ damage award would even effect MSFT's market cap.
