example out of the context of the 2nd.


1 - There is no "In order" in the 2nd amendment.

2 - Even if it did show the purpose of the amendment that does not mean the right protected by that amendment is limited to that purpose.

In order to reach the moon, we need to have a rocket.
Is the point to have rockets or to reach the moon? Surely, they are not separate thoughts.


A better analogy would be to a law or amendment that said - "As it is important for people to go to the moon, the right of the people to keep and use rockets shall not be infringed" Would that mean that people had no right to use their rocket to orbit the Earth or to fly to Mars?

If the 2nd amendment is an individual right, then, IMO, the assault weapon ban is blatantly unconstitutional

I think it is unconstitutional. Its also stupid as it outlaws weapons that are defined most by how they look rather then how they operate or what capabilities they have.

Challenge the assault weapons ban on 2nd amendment grounds using a person who is militia as defined by the US Code. The USSC has been know to trick me, but I believe that such a case forces a decision on whether the 2nd is a collective or an individual right. Whether people accept the decision is another matter, but it forces the decision.

I'm pretty sure the SC would slip a direct ruling on the 2nd even on that. They are slippery that way when they want to be.
