Q Let me ask you about these tapes. You're not in possession of any recordings of conversations you had with Mr. Marchese?
A No, the feds taped them and they've got the tapes.
MR. ARGENTAR: We'll talk about that in a little bit. Have you ever heard the tapes?
A Oh, yeah. Oh, yeah.
Q When was the last time you listened to the tapes?
A A long time ago. I don't remember the date.
Q Have you ever had them in your possession?
A Yeah, they were left on my -- my voice mail, you know and so that's where the feds taped them from.
Q So you had voice mail messages from Mr. Marchese?
A I don't know who they were from. That's why we did a star 57 protocol that and that's the feds said, if I knew exactly that it was Marchese but it could be somebody calling me up telling me I'm Marchese. Unless I have proof, I can't tell go saying it was Marchese. All I have is that it's somebody telling me it was Richard Marchese telling me there would somebody in the parking lot waiting for me.
Q Looking at request number 5, any and all documents relating to or tend to go support any assertion by you that Mr. Marchese beat or physically abused his wife or former wives, and you say copies of documents responsive to this request or enclosed. Other than the -- the documents regarding Ms. Tony Marchese's -- Marchese's testimony, before some Nevada commission, do you have any other documents that tend to support that claim?
A I didn't make that claim. Tony Marchese did. She says that Marchese punctured her lung, broke her ribs in testimony before a legislative committee in the family courts for the Mike Kale notification act, Marchese taken her kid out of the country illegal. She talked about the abuse she endured from Richard Marchese.
MR. RICHTER: Slow down.
THE WITNESS: She talked about the abuse in the testimony that she received from Richard Marchese. It is not my claim. It's Tony Marchese's claim it's public. It's on the Internet anybody can find it. Why doesn't he sue Tony Marchese for suing that.

Q So other than those documents, have you no other documents responsive to that request?
A I paid a P.I. to get all the exhibits for that but other than that, Martucci had all the exhibits too so they'd probably be in there. The phone calls between Marchese and Tony Marchese and all that. |
