No, but McData did mention in its earnings call that the Judge was supposed to have ruled on its preliminary injunction a few weeks ago. I think the most recent US Supreme Court ruling -- Festo vs SKKKC on May 28, 2002 -- may have something to do with the delay. The actual patent case itself will take longer to schedule because I think they have to go through the Markman proceeding first.

I also think that Brocade's big miss, the second big miss in the last 8 quarters, is indicative of the OEMs clamping down on its ambitions especially since most of these OEMs are rolling out important new hardware and software products. An OEM defers $10M in sales here, another OEM defers $10M in sales there and Brocade is going to be a total basketcase of a stock because of poor visibility if they don't toe the technically superior lines set by the server vendors and the storage vendors.
