Absolutely correct, but you obviously haven't followed QCOM for very long. Many international courts have upheld QCOM patents of all flavors. All the major manufacturers of CDMA equipment have signed royalty agreements to pay royalties to QCOM for all flavors of CDMA. Maybe it is time for you to do a little research on your own, since you don't seem to believe Kayaker or myself.

IMHO, China cares about the best technology, period. Time will tell, but CDMA2000 is the best wireless solution available today.
