Correct. I haven't followed QCOM closely since I left San Diego in 1993. These posts are based on logic rather than hard fact as I do not have the time or the incentive to research it more intensively.

All the major manufacturers of CDMA equipment have signed royalty agreements to pay royalties to QCOM for all flavors of CDMA

This is probably true as well. However, it doesn't necessarily mean that a currently small Chinese start-up will play along. If there is a strong enough incentive to avoid the royalty and/or enforcement is lax, it will happen and it will happen first in China.
