Yes, that was a very nice post by jaykayjones. Here's the press release on HRS vs ERICD. That finding of willful infringement is really going to hurt and make Ericsson as well as Sony think especially since Nokia has most favored nation status on IDCC's patents. This means that if Nokia so much as gains a minute advantage in cost, it can translate that into almost punitive market share gains because of the efficiency of its business model. As you know, Fullbright & Jaworski also represents IDCC in IDCC vs ERICD.

From the reports on the Raging Bull board while the trial was going on, it appears that the jury responded to HRS' argument that ERICD has a history of ignoring other companies' IP. Do you think they can use this jury verdict, particularly the finding of willful infringement, in IDCC vs ERICD to support that argument?

Texas Jury Awards Harris Corporation $61 Million In Patent Infringement Case

MELBOURNE, Fla.--(BUSINESS WIRE)--Oct. 30, 2002--Harris Corporation (NYSE:HRS - News) announced that on October 29, 2002, in the United States Federal District Court for the Northern District of Texas, a jury rendered a verdict in favor of Harris Corporation in a patent infringement case against Ericsson, Inc. The jury found that Ericsson's cellular phones and cellular base stations infringe Harris' United States Patent No. 4,365,338 for digital transmissions over a dynamic dispersion channel.

The jury awarded Harris approximately $61 million in compensatory damages and found that Ericsson's conduct was "willful." Based on the jury's finding that Ericsson's conduct was willful, the District Court could double or treble the jury award. It is likely that Ericsson will file post-trial motions and appeal the verdict.
