DFCO won a patent infringement lawsuit in April against 3 or 4
competitors who produced products similar to the Electronic ID
transponder that DFCO produces. The litigation cost DFCO a lot of
money this year. The result of the April decision was that the
competitors were banned from producing or selling any of the
competing products. Thus, DFCO has become the only producer of
a product with a fast growing market. This is great! However,
the losers in the court case have mentioned that they will appeal
the decision. Of course, if this happens, more litigation costs
and possibly a reversal of the April decision will result.

The best thing that can happen is for Schering Plough to buy out
DFCO. Since Schering is already marketing some of DFCO's products
worldwide, it may make sense for them to buy the company whole.
Aside from some efficiencies gained from eliminated Accounts Payable
and Receivables activities. The financial power of such a corporate
giant will disuade other companies from challenging DFCO's patents.
Unfortunately, the reality is that no matter how legitimate a patent
is in this country, if you do not have the financial backing of a
large corporation with a large legal department there are corporate
"sharks" out there that will try to steal your rights to exclusive
marketing of a product, especially if it is so sucessful as DFCO's
Electronic ID product. I haven't heard anything about an appeal, yet.
