You may argue all you want that a declaration of war is required to use military force.

Unilateral military force ordered by the Commander in Chief is obvious in an emergency, but the issue here is the temptation to create a "war against terrorism" intended to leverage whatever enemy can be found or created into hermetic political power at home.

Without demand for disclosure virtually anything can be accomplished by a pressured (or determined) executive, i.e., the equivalent of martial law and global warfare.

"Secret evidence" can be used as reason for incursions anywhere, incarceration of anyone. Capabilities of the executive has included overt and covert control the major media since the 1970s (see william colby's testimony at the Church Committee), but now includes new DOJ policies and Supreme Court coverage to insure any pesky whistleblowers who decide to expose malfeasance get quickly silenced.

You don't even have to believe this is happening (altho' I do, in spades), just that it can, to object to the alignment of the Patriot Act with the Bush Doctrine along with absolute insistance on total stonewalling of any indpendent investigation into the criminally-negligent failures of 9/11, the seminal event that has had the most influence on all of these issues, and on the power of this administration.
