GUIDANCE

Mr. Fagan continued, "We are progressing through our planning and budgeting process for 2003 and will be in a position to address guidance for 2003 later in the year. Our current view, however, is that our 2003 royalty revenue will continue to be affected by sales trends in the mobile wireless market, particularly the sales performance of a select number of leading Japanese equipment producers who currently contribute a significant portion of our royalty revenue. Our revenues will also be affected by our ability to expand our licensee base and our success in other patent enforcement activities.

In that regard, the potential outcomes of the Ericsson litigation (scheduled for trial in February 2003), the Samsung arbitration (we expect a final decision either later in 2002 or in the first quarter of 2003) and the Nokia Period 2 royalty rate resolution could have a material impact on our results in 2003."
