What sweeping statement? LOL. The use of "most likely" indicates probability not absoluteness. Duh!

Okay, you want to talk law of evidence? Before you can talk about the applicable law of evidence then you need to look at the evidence in question, yes? What's to stop IDCC from introducing the infamous 1994 ERICY internal memo that HRS used to support the winning argument that ERICY has historically been less than careful with other people's intellectual property?

Remember that IDCC vs ERICY was filed in 1993 and covers nearly 10 years of alleged infringement while HRS vs ERICY was filed in 1998 and covered only 20 months of willful infringement. The likelihood is that IDCC unearthed that memo during its own discovery and shared it with HRS.
