To me and to most of the world, most likely means more than likely. Tell everybody here how you concluded that IDCC would be most likely be able to use a ruling of patent infringement--which is not even final yet--in one case to prove patent infringement in another one?

Can't wait to hear your well-reasoned response.

What's to stop IDCC from introducing the infamous 1994 ERICY internal memo that HRS used to support the winning argument that ERICY has historically been less than careful with other people's intellectual property?

How about a Judge? DUH!

Depends on what the memo says, what it deals with, when it was drafted, etc., etc., and a lot of points neither you nor I know.
