You're groping, carranchie, because you have a very weak handle of the FACTS.

FACT: HRS did argue that ERICY had a historical pattern of being cavalier with other people's IP. Do you dispute this?

FACT: ERICY did have a solid patent infringement opinion, which is typically used to rebut charges of willful infringement. Do you dispute this?

FACT: HRS did use the 1994 ERICY internal memo to support its argument that ERICY's infringement was willful. Do you dispute this?

FACT: Notwithstanding ERICY's solid patent infringement opinion, the jury still found that ERICY was guilty of literal infringement of two claims, infringement under the doctrine of equivalents of two other claims, and willful infringement of those claims. Do you dispute this?

FACT: Fulbright & Jaworski is a co-counsel in HRS vs ERICY and the primary counsel in IDCC vs ERICY. Y

Because you have a very weak handle of the facts, you are clinging to a very rigid view of how IDCC can use the jury finding of willful infringement. The fair inference remains that IDCC intends to use the same 1994 ERICY internal memo. Additionally, IDCC has indicated in the past that they have depositions from ex-Ericsson executives corroborating this cavalier attitude towards other people's IP. Do you dispute that?
