The question of the century. You can look at the same "act" and have different moral judgements on the act based on surrounding circumstances. A spouse cheating on his/her partner. Violation of a marriage contract, immoral. Maybe even most people by a large majority would agree that it's immoral, but a majority may not agree that it should be prosecuted. A larger majority may believe that wife swapping is immoral. But implicitly that involves all consenting adults. Then there's polygamy where a group of people they all want to be married...wierd, immoral, illegal. It's illegal, it happens in rural areas of Utah [at a minimum], the authorities know it and they allow it. Equal application of the law?

I suppose we could make a moral judgement that sex before marriage is immoral and therefore should be illegal.
