Mel, The damages accrue against anyone, those who have been sued, and those who haven't. Also, those who have been put on notice and those who haven't been put on notice. The only difference is that those on notice could be subject to enhanced damages as willful infringers. Also, damages older than 6 years (as of the date the lawsuit is filed) aren't collectable. GRC
