First, to say that it was a war crime, you'd have to cite a relevant law. The only law binding on the US you cited had a pretty big loophole in it. What you would be better saying is that you think it ought to have been a war crime.

Second, I think when you consider the morality of dropping the atomic bombs on Japan you have to ask what the alternative would have been. In life one is often faced with having to choose the lesser of two evils. At the time, the main alternative would have been an invasion of Japan which would have produced many hundreds of casualties, perhaps millions. Personally, I think the atomic bombing of Japan was a horrible thing, although it was not a crime and was morally justified given the known alternatives.
