Did you miss the part about "intentional bombing of civilian populations" being "illegal"?
Sorry but there is no twisting your way out of this. Hiroshima and Nagasaki were civilian cities. There was no reason to annihilate the complete populations of both cities from a military point of view. As such, it was a war crime.
