The unlimited liability issue has been around forever. Here's my take. In a class action suit a large number of people combine to sue an entity. But an entity cannot sue a large number of people in combination. It would have to go after them one at a time in separate lawsuits. This seems rather unlikely in the case of retail investors in trusts. Perhaps they would find it worthwhile to go after a pension plan. I am open to correction on this issue.
