No. Please look at the wording. That is just one violation of "the laws or customs of war", quite obviously, as it is preceded by the word "OR", which suggests that it is not a "must" for an act to be a war crime. Please see my response to mjfdl :

That is just one of the possibilities of a war crime. Other "violations of the laws or customs of war" are:
- murder (...) of civilian population
- wanton destruction of cities, towns, or villages
