The only practical way that would work is if the Feds knew what users they wanted to monitor beforehand, and monitor their mailboxes, like Carnivore, and login history. That's a court order right there.

In order to track individual sessions, in real time, would require a major overhaul of how the technology works currently, IMO, and the industry wouldn't stand for it. When news about Carnivore (which was a silly little thing, really) hit the major news outlets, the ISP I work for was spammed with THOUSANDS of emails from irate customers (and even non-customers) wanting to know whether their email was being read and if so, how they could cancel their accounts. The CEO had to send a mass mailing to all our customers to let them know that we had not been approached by the FBI and wouldn't cooperate without a court order in any case. This stuff wouldn't fly. Wouldn't get off the ground.
